Terms of Service

1. Purpose

These Terms govern your access to and use of BakuGuard (the "Service"), including your rights, obligations, and responsibilities as a user.

2. Definitions

• "Service" means the BakuGuard mobile application and any associated web pages.
• "User" means any natural person who accepts these Terms and uses the Service.
• "Account" means the identifying information created via a social sign-in or other supported method.
• "Content" means data provided by the Service or entered / generated by the user.

3. Acceptance and Changes

• These Terms take effect when posted in the Service or a linked page.
• We may update these Terms to the extent permitted by law. Material changes will be announced at least 7 days before they take effect (30 days for changes that are materially adverse to users).
• Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may stop using the Service and delete your account.

4. The Service

The Service provides, among other things:

• Microphone-based detection and local logging of bruxism / snoring sounds during sleep
• Sleep session reports and statistics
• Cross-device sync and cloud backup of records
• Personalized notifications and sensitivity / alarm settings
• Advertising and any paid features that may be introduced later

5. Not a Medical Device — Disclaimer

• The Service is not a medical device and is not certified or approved as such under any medical device regulation.
• Detection results, event classifications, probability / intensity estimates, and reports are provided for general lifestyle reference only, without warranty of accuracy, completeness, or timeliness.
• You must not rely on the Service to diagnose, treat, cure, prevent, or manage bruxism, snoring, sleep apnea, or any other condition, or to adjust any treatment or medication.
• For any health concern, consult a qualified healthcare professional. The operator is not liable for any damage arising from reliance on the Service.

6. Accounts and User Obligations

• You are responsible for the accuracy of your account information and for safeguarding your credentials.
• You agree not to:
  • Use another person's account, device, or personal data without authorization
  • Reverse-engineer, duplicate, or commercially redistribute the Service's source code, models, or APIs
  • Interfere with normal operation of the Service or impose unreasonable load
  • Violate applicable laws or public order

7. Paid Features, Payments, and Subscriptions

• The Service is free to use by default and may display advertisements.
• The Service may also offer certain features for purchase, including one-time In-App Purchases and auto-renewing subscriptions.
• All payments are processed through Google Play Billing (Android) or Apple In-App Purchase (iOS). The operator does not directly collect or store raw payment credentials (card number, CVC, etc.).
• Payment, refund, receipt, and tax policies of the relevant app store take precedence.
• Auto-renewing subscriptions renew automatically for the same period unless canceled at least 24 hours before the end of the current period. You can cancel at any time via your store account settings (Google Play → Subscriptions or Apple ID → Subscriptions). After cancellation, access continues until the end of the current billing period.
• The right of withdrawal under the Korean Act on Consumer Protection in E-Commerce (or equivalent local law) is honored within the refund policy of the relevant app store. Submit refund requests first to the store's support, and contact the operator if further help is needed.
• Prices, benefits, and composition of paid features may change with prior notice; price increases apply to existing subscribers only after the current billing period ends.
• Minors must obtain consent from a legal guardian before purchasing. Guardians may cancel purchases made without their consent under applicable law.

8. Changes and Interruptions

• We may modify or discontinue all or part of the Service to maintain stable operation.
• The Service may be temporarily unavailable without prior notice due to maintenance, emergency fixes, infrastructure failure, force majeure, or outages in third-party services (Firebase, AdMob, etc.).

9. Termination and Data Deletion

• You may terminate your account at any time via Settings → Delete Account.
• On termination, your account information and server-stored sleep records are deleted without undue delay. Data that must be retained by law will be kept separately for the required period.
• We may suspend or terminate your account after reasonable notice if you materially breach these Terms or applicable law.

10. Intellectual Property and Data License

• All intellectual property in the Service — including the name, logo, UI, icons, source code, and model weights — belongs to the operator.
• You retain rights to your own content (sleep notes, records, etc.), and grant the operator a limited license to process, store, and display it solely for providing the Service.
• In addition, you grant the operator a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, and modify information collected through your use of the Service — excluding raw audio clips and limited to data processed in a form that cannot identify you — for the purposes of operating and improving the Service, training, retraining, and evaluating detection models, analyzing false positives / negatives, researching and developing new features and algorithms, and for statistical and academic purposes.
• This license may survive termination of your account only with respect to data that has already been aggregated, de-identified, or incorporated into trained model weights such that you are no longer identifiable. Detailed data-handling practices and your rights are described in the Privacy Policy.

11. Limitation of Liability

• To the maximum extent permitted by law, the operator is not liable for indirect, incidental, consequential, or special damages, lost profits, data loss, or health outcomes arising out of use of the Service.
• We are not liable for missed, false, or misclassified events caused by microphone / device / OS limitations, outages in third-party services, or user misconfiguration.
• Nothing in these Terms is intended to exclude liability that cannot be excluded under applicable law.

12. Governing Law and Disputes

• These Terms and any disputes arising from the Service are governed by the laws of the Republic of Korea.
• The competent court under the Korean Code of Civil Procedure shall have exclusive jurisdiction as the court of first instance, unless otherwise required by mandatory local law.
